THCA (tetrahydrocannabinolic acid) is a naturally occurring cannabinoid found in raw cannabis and hemp plants. In its natural, unheated form, THCA is non-intoxicating. It is the acidic precursor to THC — when heated (a process called decarboxylation), THCA converts to delta-9 THC.
Under the 2018 Farm Bill, hemp is defined as Cannabis sativa L. with a delta-9 THC concentration of not more than 0.3% on a dry weight basis. Because THCA is chemically distinct from delta-9 THC, hemp-derived THCA products that meet the 0.3% delta-9 THC threshold are considered federally compliant hemp products.
The Agricultural Improvement Act of 2018 (commonly known as the "Farm Bill") removed hemp from the Controlled Substances Act and established a legal framework for hemp cultivation and commerce. Under this law:
Important: Regulatory Changes Ahead
Federal hemp regulations are subject to change. The hemp definition and THC limits may be updated by Congress. Hightree monitors all regulatory developments and will adjust our compliance requirements accordingly. We recommend customers stay informed about laws in their state.
Every vendor on Hightree is required to provide a Certificate of Analysis (CoA) for their products from an independent, accredited laboratory. Lab testing verifies:
We encourage customers to review the CoA for any product before purchasing. If a CoA is not available on a product page, you may request it from the vendor through our messaging system.
To sell on Hightree, vendors must meet the following compliance standards:
Vendors who fail to maintain compliance may have their listings removed and accounts suspended.
While THCA products are federally legal under the Farm Bill, some states have enacted their own restrictions on hemp-derived THC products. The following states have restrictions that may affect product availability and shipping:
| State | Status | Details |
|---|---|---|
| Idaho | Prohibited | All THC products banned |
| Iowa | Prohibited | Consumable hemp products restricted |
| Kansas | Prohibited | THCA flower and concentrates banned |
| Nebraska | Prohibited | Consumable hemp THC products banned |
| Ohio | Restricted | Regulated under state cannabis program |
| Tennessee | Restricted | Products must be ≤0.3% THCA |
| Texas | Prohibited | Smokable hemp product sales banned as of March 31, 2026 |
Note: State regulations change frequently. This table is updated regularly but may not reflect the most recent changes. It is your responsibility to verify the legality of hemp-derived products in your jurisdiction before placing an order. Hightree is not liable for orders placed to restricted states.
